For Immediate Release BURR RIDGE, IL, March 4, 2009 -- Ferris Mfg. Corp., a leader in the wound care field and the maker of POLYMEM^® brand wound care dressings, announced today that it has filed a trademark infringement lawsuit in the United States District Court for the Northern District of Illinois, Eastern Division, against DermaRite Industries, LLC.

Ferris is known worldwide for its POLYMEM and QUADRAFOAM^® wound care dressings. Since 1989, Ferris has helped health care providers bring effective results to the wound healing process with THE PINK DRESSING^® brand.

In the suit, Ferris, a U.S. corporation based in Burr Ridge, Illinois, alleges that DermaRite attempted to mislead the public by falsely associating itself with Ferris and its products. DermaRite produces and sells a product called "PolyFoam" and markets it as a "Pink Foam Wound Dressing." The suit alleges that DermaRite is attempting to capitalize on the goodwill and reputation that Ferris has earned over the past two decades through its successful POLYMEM^® brand products.

"POLYMEM^® dressings are known throughout the world for their effectiveness in managing a wide variety of wounds," said Roger Sessions, D.O., Chief Executive Officer of Ferris Mfg. Corp. "No want-to-be can replace the real thing, and as such we will vigorously defend our trademarks and intellectual property."

In the federal complaint, Ferris alleges that DermaRite has engaged in trademark infringement, unfair competition and deceptive trade practices under the Lanham Act, which contains a federal statute prohibiting unfair competition and trademark infringement.

Ferris' suit also alleges that DermaRite has expropriated language from Ferris' marketing materials and falsely claimed that its product is made in the United States, when in fact it is made in England.
